The Effectiveness of Sharia Economic Dispute Resolution Between Religious Court and National Sharia Arbitration Board

Sharia economic dispute is a conflict of interest or loss for either party to the business activities carried out by individuals, groups people, entities that are legal not meet needs commercial and non-commercial nature according sharia principles. Furthermore, it can be resolved through litigation judicial non-litigation, out-of-court lines. Resolution disputes religious courts always takes long time complicated administration, but until now still in high demand justice seekers. There resolution outside judiciary, one which arbitration National Arbitration Board (BASYARNAS) solution. This paper qualitative research study with case was taken from Religious Court Class 1A Sleman BASYARNAS Representative In Yogyakarta. The findings this provide results more desirable because has executive powers than BASYARNAS, also hold absolute authority spread throughout districts Indonesia, so very easy find, contrast whose existence every capital several provinces Indonesia. superior quality judges, their presence district culture people.
